whole event. this was a shot in the arm for the harbor. >> it is a new process with the plastic lumber that we're using. and the port wanted that so that the docks would be a little bit more flexible for the high swells and for the i guess the tsunamis that could pass through here. >> reporter: as ktvu reported in july the tsunami damage was worse than originally believed. 23 of the 29 docks will have to be replaced at a cost of about $22 million. but the port director says santa cruz has been fortunate with federal emergency funds covering 75% of the cost and yesterday the harbor got a $2.5 million loan from the state. there will also be more help on hand by the way of national emergency grants that are creating hundreds of temporary jobs for people to repair tsunami damage. >> i'm very fortunate and very appreciative to have this job.

i was unemployed for 13 months. the port is still trying to raise funds to finish the lodge. but as p roject. but as you can see the first stage is done. more details now on the damage we saw from that tsunami. the crescent city harbor sustained an estimated $25 million when its harbor was pummeled by the force of the surge. one man was swept out to sea and killed. earlier this month, fema announced it would provide $6 million to help restore the harbor. city officials are saying they hope the harbor will be rebuilt by christmas. and barry bonds returned to court today. >> reporter: barry bonds has been here to the san francisco federal building many times. he no doubt hoped this might be

his last but it wasn't. barry bonds' attorneys made their best effort to get his case thrown out. they argued that the instructions the judge gave jurors were not clear and fair and they argued that the answer bonds gave to a balco grand jury back in 2003 about whether his trainer gave him anything that required a syringe was indeed rambling but not obstruction. the foreman disagreed saying bond was purposely evasive. at the end the judge said she would issue a ruling later. >> it's unlikely she will throw it out. she would be more inclined to uphold it. i think the surprise would be that she threw it out. the defense has tough, good arguments i think that's one of the reasons the the judge

wants to think about it and write it up. >> reporter: how was the game last night? >> it was nice. >> reporter: bonds answered questions about the game he attended last night but not about what happened or did hasn't in court. >> going back to day one, he's always had confidence in the system. felt that the system would do justice and nothing has changed. >> reporter: if the judge upholds his appeal, barry bonds will be sentenced here in about three months. then no doubt he'll appeal. reporting live in san francisco, rita williams, ktvu channel 2 news. pinol police tell ktvu a third man has been arrested in connection with yesterday's attempted robbery of an armoured car. police say williams fuller was arrested last night. he's accused of driving the get away car for two brothers who police say tried to rob that armoured car. 25-year-old pierre daniel was killed yesterday in the shoot out. freddy daniel is in critical condition tonight. pinol police resource officer bryan justin tacas was also

shot along with a security guard. >> he was a great guy. he was a comptroller in afghanistan. >> both tacas and the security guard are recovering tonight. today san francisco police released a sketch resembling the attacker in a vicious beating inside a bathroom at candle stick park. the man they are looking for is a samoan or pacific islander in his 20s. about 6'tall, weighing 220 pounds with a goatee and ponytail. the beating was part of the violence that happened during the 49ers game. a bill will focus on punishment and getting witnesss to step guard. it also would make certain crimes committed at games subject to enhancement resulting in longer sentences. >> there's a lot of things out there worth fighting for.

your country, a certain causes, your family, but the color of a jersey just isn't one of them. >> reporter: the bill would require proteams to pay into a fund that would make reward money available when crimes do occur. san jose today welcomed back almost two dozen firefighters who were rehired last month thanks to a federal grant. the firefighters lost their jobs last year due to budget cuts. they are sworn in during a reinitiation ceremony at the fire department's training center today. mayor chuck reed was on hand. alameda county workers expressed anger today over a report that some managers are getting an extra taxpayer funded retirement fund during a time of staff lay offs. >> union workers picketed outside the alameda county spear your court at noon today. some say they are prized by a

contra costa times report that shows that some will receive a pension plus what are known as deferred compensation paid by the county into a separate account. >> we have to pay our own deferred comps out of our paychecks, i had no idea that was one of their benefits and also that they had a second retirement pension. >> alameda county's sheriff, district attorney and county administrators are among those county officials who receive this extra benefit. governor brown unveiled an ambitious plan to create jobs here in california. it involves a change in the tax code for san francisco. >> any time an out of state company moves a job into california they get an instate

tax credit. >> he says the switch will encourage business to create jobs in california. by taking and shifts what is an unjustified tax provision and moving it over to a justified tax incentive, that i can win over support in the business community and possibly win four or five votes from the republicans therefor i get it passed. >> brown says he wants to use the estimated $1 billion generated to expand employee tax credits for small businesses. and give tax breaks to companies that buy new equipment. it's not clear if brown can get republican votes for that plan. gop leaders said it would create few jobs.

after the announcement of steve job's retiring, many wonder what will happen to apple. >> it took four ceos for the company to regain a strong identity and to develop the kind of track record that it had while walt disney was in place. it took until michael isner. >> the next product announcement will be critical for apple. the company stock -- eventually rebounded by the end of the day. apple closed at $373.72 a share. ktvu.com has more information on steve jobs, including his time line. the senate rejected a bill that would have given some prison inmates a second chance at freedom. the measure was aimed at juvenile offenders who were

sentenced to life in prison. leland yee authored the bill. east bay state senator lonnie hancock abruptly removed a bill. an assembly was scheduled to vote on it. hancock says while repealing the death penalty would save the state hundreds of millions of the dollars the bill didn't have enough support to pass. a bay area landmark is getting a new coat of paint. crews are giving the main suspension cables of the golden gate bridge a complete make over for the first time in almost 75 years. there were no paint crews out today because of the foggy weather but when that fog lifts there'll be putting down two coats of international orange paint on the span. the project is expected to take four years to complete.

a new political strategy is on the table tonight. the strange fellows you could soon see on the campaign trail. caltrans is kicking out these skateboarders everyone though the park was built for them. the change they said makes skateboarders skateboarders trespassers. and we're going to be looking at the latest weather and the heat.

crews realized the amount of crews -- ed lee jumping into the mayor race could pave for a new way to get elected. >> reporter: ed lee's strong support is causing opponents to share strategies. >> to see where one candidate has a high marks and he gives a sense, we're a little bit below that. is there a way that you can craft a method that people have in common that can work for everyone. >> reporter: but mayoral candidates last month united to call for an investigation into the run ed run campaign that helped push lee into the race. other candidates call it a

pescadero are warned to keep boiling their drinking water. water service there has been restored since a broken pump was replaced yesterday. the state department of house still hasn't determined if the water in the system is now safe to drink. county officials say that should happen as soon as tomorrow afternoon. meanwhile local restaurants are closed until the tests are complete. within the past 30 minutes, president obama declared a state of emergency in north carolina in anticipation of hurricane irene which could hit the unite on saturday. >> this is what it looked like in the bahamas today as irene battled homes and business causing damage throughout the wind damage. winds of up to 115 miles per hour knocked down trees. so far there are no reports of any deaths or injuries. back in the united states evacuations are under way in some parts of north carolina now. mandatory evacuations on dare island forced about 150,000

people mostly tourists to pack up and leave. island residents were told they have until tomorrow to evacuate. the entire north carolina coast was placed under a hurricane warning this afternoon. forecasters say irene could hit north carolina with sustained winds of 110 miles per hour. and people at martha's vineyard are not taking any chances either. storm preparations are under way there including boarding up windows and pulling boats out of the water. atlantic city is now in the suspected path. it's incredible to see how massive hurricane irene is when you see it from out of space. a distinct eye is seen in the

center. chief meteorologist bill martin is tracking irene in the weather center and bill is it getting stronger tonight. >>irene was forecasted to build up into a category 4. but it has backed up from that. the east coast has not been hit in four years. there's something else that is unusual. and i'll show you that on the map. a category 3 as it stands. florida is fine, parts of georgia certainly fine. as you head into the carolinas things start to change around. you can see the path and out here in the outer banks of carolinas on saturday. it moves on shore as a category 2. here is the unusual thing. this thing wants to be the -- the models want to keep it as a category 1 as it moves toward the carolinas. that doesn't happen, you don't get hurricanes in the city of new york. it has to be a rare rare

occurrence. this category 1 will be very weak if that does occur. across atlantic city, new jersey, things could change. a very unusual hurricane taking an unusual path. tonight at 10:00 i'll come back and we'll certainly update the latest models. these models are updating constantly. tonight fog comes in warmer tomorrow, it was nice today. tomorrow warmer and warmer still on saturday and sunday. no heat wave but certainly into the mid-90s as we go into the bay area weekend. everybody out in the avenues of richmond, daly city, pacifica, fog low clouds as it has been for the last month or two will continue with the chance of drizzle. then it burns back rapidly and you're going to see plenty of sunshine tomorrow. and we are headed into a warm up, a warming trend.

the other has a date with the bulldozer. the city of oakland declined to renew its lease on the land so caltrans says it has no choice but to tear the park down because of liability issues and skaters say it's a shame. >> the same thing is that now it's gone. and it was not based off of any place to do drugs, just have fun skateboarder. like ride a skateboard. >> caltrans says it will demolish a second skate bard in the coming week. what a disaster for the oakland a's. >> they were involved in history. >> not because they wanted to be. >> that's the glass half full thing. not the kind of history as julie said. three grand slams by the yankees. there have been three grand slams in the game before but not by the same team. unbelievable too. the a's were leading 7-1. here come the yankees.

suddenly it's 7-6, then it's russell martin. this bases loaded shots makes it 10-7 new york. and then icing on the cake, curtis granderson wow, 21-8 at this point. yankees lead and 22-9 is your final. the giants play tonight, the team they're chasing in action and circling the bases here chris young with a 2-run shot. so far in the 8th inning it's holding up. the diamondbacks leading the nationals 2-1. they lead the giants by two in the west. 49ers getting ready to take on the texans this weekend. and coach jim harbaugh says he has his plans. the second stringers are going to get plenty of work in this game. alex smith will probably just play one series the rest will go to collin capernick. >> i would rather have collin
